Terms and conditions

These terms & conditions (also known as agreement) apply to all services and events organized by Swell for Good (S4G). This agreement is applicable to all users of our service, and we advise that you read these terms and all other incorporated agreements and guidelines very carefully so that you are at all times aware of your rights and obligations as our customer/guest.
The service
Swell for Good offers adventure trip with kitesurt and social activities during the trip including accommodation, village guiding, transfer, and other services (also referred to as the ’S4G package’).  You understand and accept that the S4G package can vary depending on the opportunities during the trip. A list of activities are outlined in the destinations description. Swell for Good customises package based on village activities opportunities, members 
The process of application
To apply for S4G package, you must submit your application online (Book Now page). By submitting the application, you accept these terms and conditions, and will be legally bound by them. 
Once you have submitted your application, we will send you a message disclosing the payment method that you may use to complete your application process. Please note that we will send the message through your preferred email and selected mode of communication.
Once we have received and confirmed the payment of the S4G package, we will send you a confirmation of payment. You are required to pay minimum 50% deposit of the selected trip to secure your spot.
Once the trip has attained the minimum number of guests as displayed in the destination in the website, we will send you a confirmation and welcome e-mail. We will always make sure to confirm every tour at least 30 days prior to the beginning of the tour. The full payment of the tour package must be balanced to our account minimum 45 days prior to the trip.

Flights, visas and travel insurances 
As a user of our services, you are fully responsible for arranging your own flights, visas and travel insurances. We will under no circumstances be responsible for your flights, visas and travel insurance. We advise that you wait until we have sent you a confirmation email and the official welcome letter before you arrange your flights, travel insurances or in case of overseas trips, visas.
Accommodation, food and transport
Swell for Good partners with third parties to arrange accommodation, food and transport at the destination. You however understand and accept that while we will take reasonable steps to ensure that the accommodation, food and transport provided by such third party providers and local partner are based on the nature of the trip, we will not be liable for the actions or inactions of such third party providers in the provision of such services. 
Cancellation & Refund Policy
Swell for Good reserves the right (and may exercise such) to cancel any trip where minimum number of guests are not reached. If we so cancel a trip due to limited number of guests, we will provide a full refund.
Swell for Good reserves the right to cancel any trip due to natural catastrophe or if conditions are unsafe to continue the trip. In such a case, we will follow the refund policy of the third parties for accommodation, food and any other touristic services arranged through a third party. We will provide a full refund of S4G’s service fees.
If you decide to cancel your booked tour, and give us a written notice of your intention minimum 45 (ninety) days prior to the commencement of the trip, we will issue you a full refund less a $250 administration fee. 
If you decide to cancel your booked tour, and give us a written notice of your intention minimum 30 (sixty) days prior to the commencement of the trip, we will issue you a 50 per cent refund of your payment. 
If you decide to cancel your booked tour, and give us a written notice of your intention 29 (thirty) days or less prior to the commencement of the trip, we will not issue any refund.
Each trip can includes excursions, up or down-winder trips or other local activities. Swell for Good will not be liable for a refund if you decide not to take part in any or all of these activities.
You admit that any changes to flights or accommodation aren’t covered by Swell for Good and no refund will be provided by us due to flight cancellations.
For all eligible refunds (as defined above), the amount due for refund will be so refunded within 30 days after the cancellation request and bank details of the client are submitted in writing to us.
Other important conditions
We make our services available for the use of persons who are 18 years old or older and are able to form legally binding contracts. If you are a minor, you may only use our services under the guidance of a parent/guardian.
You will be responsible for your own actions during the trip. All activities are undertaken at your own risk and you hereby certify that you are aware of the risks involved.
You are responsible for organizing your own travel insurance and ensure that kitesurfing is specifically covered by your insurance.
Private kite lessons are excluded from all S4G. 
S4G does not provide any kite material during the trip. All participants need to bring own gear.
S4G reserves the right to modify the trip itinerary based on weather conditions such as but not limited to wind, tide or other adverse weather conditions.
Guests are required to comply with directions and instructions provided by the S4G team as well as the authorized representatives of S4G local partners. We reserve the right to exclude participants who create an unsafe environment with their behaviour from any or all touring activities with no liabilities on our part and with no refund.
We will not be liable for the actions or inactions of participants that may cause accidents, hurts or damages to other participants or members of the public or to their property or equipment. Each guest will be solely responsible for their actions and inactions, and for whatever consequences result from such actions or inactions.
You are responsible for informing S4G ahead of time if you have any special dietary requirements/allergies or illnesses. You understand and accept that we will not be responsible for any hurts, damages or accidents that you may suffer as a result of not informing us of any special needs that you may have.
Any incidents or injuries during the trip are to be reported to the S4G team. We will arrange medical treatment or emergency evacuation services for the participant at the participants’ cost and contact a nominated emergency contact if necessary. S4G does not take responsibility for any expenses in the event of an accident.
Indemnification
You agree to defend and indemnify S4G, its subsidiaries and associates, their officers, executives, and agents, not guilty from and free from any claims, damages, liabilities, compensations, and expenses, such as but not limited to, accounting fees and reasonable legal costs, related in any way with your use of S4G’s services or your breach of these terms.
